Terms & Conditions

The Client hereby engages NetStripes (the Provider), on a non-exclusive basis to provide the Services to the Client, and the Provider hereby accepts that engagement and agrees to provide the Services to the Client, in accordance with the terms below. All services are provided under NetStripes Service agreement.

The following steps describe the terms of engagement of this project.

  1. Draft online brand design will be sent to the client for your feedback and approval within a specifiedperiod from the receipt of the confirmation payment.

  • In ensuring the project is kept to timelines, the client is to provide, approval or anyrequest for changes within 3 business days of receiving our draft design.  Maximum time for design approval or request for any changes should be no longer than 3 days (due date) and any subsequent changes need to be approved within 24 hours (revised due date) of the change being sent to you.

If no feedback is received within the given time, NetStripes will endeavour to send a reminder on the revised due date and the project may move into development phase the next day.

The above timelines and process will also be adhered to whenever approval is required from the client throughout the project cycle.

  • Changes in design are generally not recommended once the development begins as it hampers project deadlines and incurs additional effort and cost. Any such changes will be quoted for separately at a nominal rate of $100 an hour.

  • Features requested once the project has commenced will be quoted separately. All changes should ideally be made prior to the completion of design in avoiding delays and additional costs

  • Design Revisions – NetStripes will provide at no extra cost to the client up to one revision for Solopreneur Web packages, two revisions to clients for Gold and Platinum Web Packages and three revisions for Platinum Plus web packages.  Text revisions are not considered revisions.

  • Content: The client is required to supply images and content required for your website.  We will advise you of the required content via email or through a document referred as the “Content Calendar”. The content may include, but is not limited to, photographs, written copy, logos and other printed material. In achieving timeline and cost related goals of the project, the timing of the content required is provided to the client within a week of confirmation. It is important the content is provided within these timeframes to ensure smooth progress. Yes content delays impact project timeline.

  • Continued delays in providing content - Clients are advised that delays in providingcontent or approval has an impact on project completion costs due to increased cost of resources in coordination, design and development. Every week the project is delayed due to delays in approvals, and content delivery will incur a nominal fee of $150 per week.

  • Domain -  If you do not already have a domain name registered, you will be required toregister a domain name of your choice. If you would like us to do this for you, it can be done at an additional service fee of $75– excluding your domain cost and GST.

If you already have a domain and wish to continue using the same domain for your new website, you will be required to provide domain credentials the latest by 7 business days from your new website launch date. We will not be liable for any delays or other technical issues related to moving your domain records from your existing provider.

  • Web Hosting - If you do not already have a web hosting provider, you will be requiredto purchase a hosting package from a web hosting provider of your choice and provide us such details at least 7 days prior to the date required for your website to be hosted and available on the world wide web.  We will be able to provide you with a list of providers if required.

In case you decide on NetStripes hosting your website through our preferred provider, it must be noted that NetStripes cannot be responsible for any kind of hosting/server issues of the hosting provider that may occur. This service is only provided on request and we will not be able to provide complimentary support in relation to resolving any hosting related issues.

  1. Email Hosting - While most web hosting providers offer a certain number of email accounts (if not unlimited) included in their packages, we do not recommend our clients   combine their web and email hosting with the same provider.  The reason for this is to avoid significant issues of single point of failure. This means when you have one provider for both website and email, if your website is down due to server issues, your email system will also not work and vice versa.  You will need to assess the risks of your email system being linked to your hosting provider and your website.

As an alternative, if required NetStripes are able to provide you with a list of suggested email hosting providers for your consideration.

If the need does arise NetStripes will be able to assist you in setting up your email configurations at a nominal cost.

Alternatively, you may contact the provider yourself for configuration.

In the case that you need our assistance for email configurations, you will be required to provide Administration details of your email hosting provider at least 7 business days before we launch your site.

  1. Ownership of Code and Content - Once all payment instalments are made in full for the website package you have subscribed for and any other additional features requested, the ownership of the website which includes design and development of your website will be transferred to you irrevocably. Your right to use the website immediately ceases and the licences granted under this agreement terminated if you do not pay your instalments on time and NetStripes shall be entitled to immediately remove all website material from your web hosting provider and computer.

  1. Ownership of intellectual property rights - You must obtain all necessarypermissions and authorities in respect of the use of all copy, graphic images, registered company logos, names and trademarks, or any other material that you supply to us to include in your website or web applications.

You must indemnify us and hold us harmless from any claims or legal actions related to the content of your website.

  1. Consequential Loss ‐ We shall not be liable for any loss or damage, which you maysuffer which is in any way attributable to any delay in performance or completion of our contract, however that delay arises.

  1. Backups - You are responsible for maintaining your own backups with respect to yourwebsite and we will not be liable for restoring any client data or client websites.

  1. 15.    Disclaimer ‐ To the full extent permitted by law, all terms, conditions, warranties,undertakings, inducements or representations whether express, implied, statutory or otherwise (other than the express provisions of these terms and conditions) relating in any way to the services we provide to you are excluded. Without limiting the above, to the extent permitted by law, any liability of NetStripes under any term, condition, warranty or representation that by law cannot be excluded is, where permitted by law, limited at our option to the replacement, repair or resupply of the services or the payment of the cost of the services that we were contracted to perform.

Futurise Terms & Conditions

1. Engagement

Thank you for accepting our offer to present Futurise to you. By signing an Order Form, you acknowledge that you have read these Terms & Conditions and agree that the placement of an Order, together with these Terms & Conditions, forms a contract between you and NetStripes. You also warrant to abide by the specific Terms & Conditions of NetStripes’ chosen event provider whether additional or varient Terms & Conditions may or may not apply.

2. Acknowledgements by Participant

  • All information including materials referred to or provided to the Participant by the Presenter has been obtained by the Presenter solely from their own experience and is referred to or provided as general information only, by which:
    • will require further research to identify its application to the specific requirements of the Participant; and
    • will, dependent on the further research to be undertaken as referred to in subparagraph (i) above, require modification to appropriately apply to the specific requirements of the Participant; and
    • is referred to or provided by way of example only and is not intended to be, nor is it acceptable, as specific business recommendations or advice specific to the Participant.
  • The Participant shall not duplicate by any means whatsoever any of the information.

3. Release

The Participant releases forever the Presenters from all and any responsibility or liability for any losses, claims or demands that directly or indirectly may be incurred as a result of the Participant using the information obtained for business or other purposes.

4. Authority

The Participant acknowledges that the Presenters may photograph and/or record the seminar in which the Participant is attending and authorises the Presenter to utilise any such photographs and/or recordings in any manner whatsoever.

5. Investment and Payment

  • You agree to pay the Investment Sum described on the front of this Agreement for Futurise. Tuition includes the session(s) and applicable course materials. Transportation, lodging and food costs are not included.
  • Payments made under this agreement must be made by the means specified in the Order Form, unless an alternative agreement is agreed by NetStripes in writing.
  • Should the Participant not pay to NetStripes an Installment Sum by the Installment Payment Date for that Sum then all monies owing by the Participant to NetStripes will become due and owing immediately to NetStripes without set off or deduction or counterclaim and without need for further demand, unless otherwise confirmed in writing by NetStripes.
  • If a deposit has been taken as part of this agreement, you agree to settle the balance within 14 calendar days prior to the event start date. If the balance is not settled in this period, we reserve the right to charge the full retail value of the event purchased.
  • NetStripes reserves the right to withhold the provision of event services until the full payment under this Agreement is received.

6. Default, Cancelation, Termination & Damages Fee:

  • No Show Fee: If you do not attend Futurise without express written consent from NetStripes, you will forfeit your Investment Sum for the event.
  • If you advise in notice in writing via electronic mail before close of business three (3) working days after placing the Order that you do not wish to attend Futurise, this Agreement shall be at an end and we shall refund you all monies you have paid to us under this Agreement. If a refund is due from us to you, we will process it within 30 working days. Should you wish to cancel after three (3) working days have elapsed, any monies already paid will be forfeit. We do not accept verbal cancellations.
  • You acknowledge that you shall not be entitled, and shall not claim a refund other than by strict compliance with clauses in this Agreement. You further acknowledge that this is an essential term of this Agreement on which we rely.

7. Validity

Registrants must personally attend all programs, seminars, webinars, advisories etc. in the package. No individual programme is transferable to another person without written approval from NetStripes. Should approval be granted, a $150.00 transfer fee will be payable by the Participant. There is no credit for events not completed within the program period.You shall have no claim against us for a refund on unattended programs.

8. Transferring Tickets

a. Subject to availability and the applicable transfer fees, you may transfer to another event or seminar of equal or lesser value one time; provided however that such transfer shall only be valid for an additional 12 months from the start date of the Futurise event from which you are transferring. You must do so by notifying us in writing. If you choose to transfer, you relinquish your priority standing in the program for which you were enrolled, and your transfer is subject to availability of the next event. If you transfer within 90 calendar days of your scheduled program, because it would be extremely difficult or impractical to assess the actual damages suffered by NetStripes because of your transfer, then as liquidated damages, and not as a penalty, the following amounts apply, and in the cases other than forfeiture, will be added to any unpaid balance to your Investment Sum for the Futurise event.

b. In the event that you are unable to attend the event you have booked and paid for, you can transfer your ticket to a nominated new Participant subject to notifying us in writing at least 30 calendar days before the event starts, and providing us with their full contact details. An administration fee of $150.00 will apply. You may also choose to attend a different event of a lesser or equal value instead. You will not be refunded any difference in price. Your payments will be reassigned to the other event, subject to the following criteria. You will still need to make all required payments for that event, and you must also attend the event within 12 months from the date of the original event you were enrolled for.

c. Should you not attend a rescheduled or similar event for any reason, there will be no credit for future events and you shall have no claim against us for a refund. Should you wish to transfer to another event, this can be done subject to availability and will incur a $150.00 transfer fee.

9. Time and Place

  • Your payment to us entitles you to:
    • attend during the event hours; and
    • receive a copy of the Materials, if any.
  • We reserve the right to amend or cancel any event, event times, dates, venue or speaker. We will notify you in writing of the changes we make and:
    • we shall have no liability to you; and
    • you retain the right to reschedule; and
    • you shall make no claim against us (including a refund), in respect to the same.

10. General Provisions

  • Digital Advisory: three (3) months (six 30-minute sessions) of individual digital advisory with one of NetStripes’ digital experts must be activated and completed within 90 calendar days after the event. The advisory received with Futurise is non transferable.

11. Force Majeure

If the event as contemplated by this Agreement are prevented or cancelled because of an act of God, an inevitable accident, fire, blackout, flood or any other calamity, or if by reason of strikes, or lockouts, or any other events beyond the direct control of both parties, then NetStripes, at its discretion either postpone the event from the original event date or cancel and refund as per the appropriate clause stated in this Agreement.

12. Satisfaction Guarantee

If for any reason after attending Day One of Futurise you are not completely satisfied that the information presented will be beneficial to your business, let us know and NetStripes will refund any monies owing to the Participant. Turn in your Manual, your name badge and any other materials to our Customer Service representatives, and we will send you a refund for the Futurise event within 30 business days. There will be no reimbursement for any transportation, accommodation costs or any other costs you may have incurred.
